		<description>I have contacted several sploggers' IP servers in the name of those who wanted either out right theft of their entries and placed in Splogs, or had their entries linked to them by sploggers; all without permission or knowledge of the authors.

ALL of the IP servers used mumbo jumbo when it came to their position as hosts for these sploggers, saying that THEY (the IP server) "is not responsible" for the content of the blog and as long as there is no outright copyright infringement there is nothing they can, nor will do.

They have a ream of info that they want sent in to their own "copyright infringement departments," such as copies of the entry in question, proof that it is the original, the author's email address and yada yada.  Once they have received these BY US MAIL (they do not accept email), they will "study the situation" and make a decision.

Of course their decision will be that there was no theft and that their TOS was not broken by the sploggers.
There are loopholes in the "Internet copyright" regs and there are thus going to be loopholes for these damned sploggers to utilize to get around it.

At one site, in the "About" section, they actually admit that they only give a short summary and then a link, so as to NOT break the copyright law, therefor they are only "giving out information concerning entries written, which would otherwise be missed by possible readers," which is bs because they use Google and Technorati and other major RSS feeds to steal from.

One actually, as seen in my blog, wrote a reply email to a friend, that stated somethng like "most authors are very happy that we link to them..." 

This is an incredible problem and until sites like WP can come up with some way to protect the blogs, or other ways of goverance of the feeds...or whatever...sploggers will continue to steal entries.

First, if someone steals your work, you're generally better off reporting them for a copyright violation than as spam. Hosts can remove spam at their discretion but the law holds them liable if they fail to remove infringing material in most cases.

You can do that by filing a DMCA notice with the host. You can also report them to their advertisers through that method (in many cases) and also the search engines.

It's the fastest way I know to handle such matters and what I use. If you need stock letters, I have them on my site as well as contact information.
